Victory for Single Mother Facing Eviction Keeps Family in Home

Last September, Tarolyn and her young sons were facing eviction.  They live in subsidized housing in Miami Gardens, and the landlord attempted to terminate their housing and avoid the procedural safeguards in place for tenants living in subsidized housing—as well as making false allegations about Tarolyn.  If evicted, they would not have been able to afford a place to live, because their current housing subsidy ensures that their rent is commensurate with Tarolyn’s income.

Legal Services Staff Attorney Michael Angelo Tata represented Tarolyn in the case. After more than 100 hours of legal advocacy on his part, the Judge ultimately agreed with his position and found that the landlord was in violation of Florida law.  As a result, the Judge dismissed the eviction, and Tarolyn and her two sons were able to remain in their home and maintain their housing subsidy. The case will be published in the April edition of Florida Law Weekly—a first for Michael Angelo, and another success for Legal Services.

Miami Dade’s housing affordability crisis disproportionately impacts our low-income community.  For Tarolyn’s family, legal representation meant the difference between staying in their home and experiencing the trauma of being evicted without anywhere to go.
